NYC Withheld Tuition Reimbursement for Children with Disabilities During Pandemic

A federal judge has ruled that the New York City Education Department illegally withheld tuition reimbursements for private school students with disabilities over the course of the COVID-19 pandemic. The department is required by law to pay for students with disabilities to attend private school if the city’s public schools cannot accommodate their special education needs. When schools closed last spring, the city stopped reimbursing tuition for private schools that it claims did not provide remote learning plans for approval. At least 1,000 students were affected, with some parents saying they had to go into debt to cover the high cost of private education on their own or withdraw their children from school altogether.
